Is My Australian Shepherd a Merle?

I’m a new Aussie owner and my puppy is 5 months now but I always questioned his coloring. His breeder said he was a black tri (white, black, and copper) but ever since Bandit was a baby he had this weird splattered pattern on his face that looked merle.

It hasn’t gone away or matched his fur so now I’m questioning the breeders? Someone, please help me! I did a lot of research but it could be multiple things (mismarked, merle, phantom merle, or double merle).

What are your thoughts?

If he has ANY merling, he is a merle. It's a bit hard to tell from the photo, but I believe you can see some merling there.

Definitely a blue merle, just a really dark, heavily merled one. His markings are fine, well within breed standards.
